2. Insurance Services

Independent Brokerage

First Liberty Life is a licensed independent life insurance brokerage operating in the State of Texas. We are not an insurance carrier. We work with multiple admitted insurance carriers to help you find life insurance coverage that fits your needs and budget.

Not a Guarantee of Coverage

Requesting a quote or submitting an application through the Site does not guarantee approval of coverage. All applications are subject to review and acceptance by the issuing insurance carrier. Quotes provided through the Site are estimates based on the information you provide and may change based on underwriting review, product selection, and other factors.

Agent of Record

By submitting an application through First Liberty Life, you designate us as your agent of record for the applicable insurance product. You authorize us to communicate this designation to insurance carriers and to receive compensation from carriers in connection with your policy. Agent compensation is included in your premium and does not increase the cost of your policy.

Policy Terms Control

In the event of any conflict between these Terms and the terms of an insurance policy issued through our services, the terms of the insurance policy shall control.

3. Accuracy of Information

You agree to provide accurate, complete, and current information when using the Site, including when requesting quotes, submitting applications, or communicating with us. Inaccurate or incomplete information may result in incorrect quotes, delays in processing, or denial of coverage.

We have no liability for any consequences arising from inaccurate or incomplete information that you provide.

4. No Professional Advice

The information on the Site is provided for general educational and informational purposes only. Nothing on the Site constitutes legal, financial, tax, medical, or investment advice. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE SITE, INCLUDING QUOTE ESTIMATES AND EDUCATIONAL MATERIALS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FIRST LIBERTY LIFE, ITS OWNERS, OFFICERS, AGENTS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR OUR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

11. Indemnification

12. Governing Law and Jurisdiction

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in the State of Texas, and you consent to the personal jurisdiction of such courts.

13. Dispute Resolution

Before initiating any formal legal proceeding, you agree to first contact us and attempt to resolve any dispute informally. Please send a written description of your concern to the contact information provided below, and we will make good-faith efforts to resolve the matter within thirty (30) days.

If the dispute cannot be resolved informally, either party may pursue resolution through the courts as described in Section 12.

14. Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

15. Electronic Communications

By using the Site or providing your contact information to us, you consent to receive electronic communications from us, including emails, text messages, and phone calls related to your quote requests, applications, and policies. You may opt out of marketing communications at any time, but transactional communications related to active quotes or policies may continue as necessary.

16. Website Availability

We may modify, suspend, or discontinue the Site or any part of it at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Site.

The Site is intended for users located in the United States. We make no claims that the Site or its content is accessible or appropriate outside of the United States.

17. Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and First Liberty Life regarding your use of the Site, and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
